Defective non-lapsing death benefit nominations

In both decisions 613577 and 616775, the member of the superannuation fund made defective non-lapsing death benefit nominations (‘NLN’). The payment of the death benefit was then decided by the Australian Financial Complaints Authority (‘AFCA’) having regard to the terms of the fund’s trust deed, the legislation and the policy underlying the legislation.
